Nashville New Homes: The “Occupancy After Closing Agreement”

Wait a minute!  When you purchase a NEW home, there is no need for an “Occupancy After Closing Agreement” …. right?

Just think back to May of 2010.  Pretend you had just closed on your home purchase and gave the sellers a week to move out before assuming posession.  Then comes the great flood.  Your home has two feet of water in it and all of the seller’s stuff is ruined.  Even though you own it, you are technically not yet the owner-occupant.  You have insurance on your contents, but its not your stuff floating around.  Even if the sellers had not cancelled their policy, would their insurance company still pay the claim with a wagging tail knowing their policy holder did not own the property?  Lots and lots of complications.  Situations like this, although rare, do happen.

You, the buyer, might also have everything loaded and on the way only to find out there is a complication in the title work and your loan cannot close on time.  Can you say “MOTEL?”

Nashville New Homes: The Buyer Representation Dilemna

  In over 11 years of on-site new home sales, I have always had the utmost respect for Realtors serving as Buyer-Agents.  They drive clients around to every home that remotely comes close to meeting their specific needs and also keep a vigilant watch for new listings.  They schedule entire days with their clients to evaluate their many choices.

 And then their home buying clients venture out on their own and in many cases develop an interest in properties that have nothing at all in common with the “need query” their agent is trying to satisfy.  All of a sudden, everything “having to be on one level gives way to all bedrooms upstairs,” simply based on the size of the master bedrom and suite bath.  Go figure.

I know this, and have always made it a practice to discover what Realtor the prospect is working with, and after their visit, calling that Realtor to let them know of their client’s visit, and their level of interest in purchasing one of our new homes.  I truly feel this is the right thing to do. 

If I was their agent, I would certainly appreciate the “heads up.”  Over the years, 99% of the Realtors I have had the pleasure to work with have been very appreciative of our bringing their client a step closer to purchasing!  But that leaves the other 1%.

This year has been very perplexing and has put my thoughts of the “right or wrong” thing to do through the ultimate tests.  

Several weeks ago, a very nice family arrived at one of our model homes.  They had seen our “human sign spinners” and came in to investigate.  They really loved what they found.  After all, where else in Metropolitan Nashville Davidson County can you purchase a brand new 3 bedroom, 2 bath home with a garage for $110,000….. with the seller paying all closing costs?

The family left excited and could not wait to call their Realtor to start the process.  With these homes selling fast, I called their Realtor as soon as I could return to the office to bring their visit to attention. 

(Rather than say it was a him or her, I will say their Realtor was an “it.”)

  I spoke to “it” and gave all the details of my visit with the client.  The immediate, yet sarcastic response was “Oh no, you have no clue what they want or need.  They do not want to be in that neighborhood.”

Hmmm.  I was just with them.  They loved the home.  Their only added desire was a smooth top range and side-by-side refrigerator!  Their best friends live right next door.  What did I miss?   Even more, why did I make that call?  

I made the call because it was the right thing to do, especially for the 99% of Buyer Agents that deserve, and would appreciate that call.   Several weeks passed and no sign of that family.  I did follow up with a personal thank you card to the family, but did not want to interfere with their “representation” by “it.”

Yesterday, the family re-appeared, with checkbook in hand ready to purchase the home they had been so excited about.  I asked if their Realtor would be joining us, and the answer was a resounding NO

They informed me that “it” would only show them listings in a different part of town and was virtually refusing to show them anything, or anywhere else.  They were very clear… “It” would not be representing them in any way.

This family will soon be moving into their brand new home and couldn’t be happier.  Their parents are also moving to Nashville next month and left a deposit on a homesite around the corner.  They are all happy, I am happy, and Ole South is happy.  

“It” probably won’t be too happy.  What would you bet that I get a call from “it” insisting on being added to the contract as Buyer’s Agent?  Procuring cause?  My ass.

Being a Realtor is all about bringing willing sellers and willing buyers together.  Everyone has a different idea of what the “perfect home” should be and we Realtors really have no right to impose our personal objections or desires, when they are different from our client’s. 

Whether “it” was simply trying to limit this family’s selection to a certain listing, or “it” really did not personally like another particular area of town, the buyer’s desires and interest clearly were not being addressed. 

And “it” lost out on not one, but two sales.

If “it” had been attentive to our “courtesy call,”  “it” would be in our Yes Club for Realtors from the first sale, and received 4% commission on the second sale… and all future sales for 2011 & 2012. 

The moral of the story…. when a prospect is interested in a new home, especially one built by Ole South, go with them to look at it.  It will be a deal.  They will be happy, and you will be too.

So much for the 1% and thank goodness for the other 99%.  Perhaps we can create another professional designation for those “its”….CDA.  (Certified Dumb Ass.) 

In the meantime, I’ll continue calling Realtors when their clients show interest in our homes and keep my fingers crossed that they will fall in the 99% category!

Nashville New Homes: Take time to smell the mulch.

I can now cross another item from my “bucket list.”   I have lived to be 50 years old.  And..other than being fat, I feel pretty darn good!   I am thankful for having many good friends that helped make turning 50 more fun than it would have been otherwise!

It also helps to see that I am not the only one getting older.  Remember Ruby?

Birthday week 2011 will be one to remember.  From a surprise gathering at The Black Pearl at Blackjack Cove Marina on Old Hickory Lake, to dinner at Nero’s in Green Hills … the surprises keep coming.   It was a pleasant surprise to learn that “Nero” is actually still alive and well.  You see, man can live by corn cakes alone!  Like me, this restaurant has been in Nashville for 50 years plus also!  http://www.nerosgrill.com/

Nashville New Homes: The stupid questions are the ones you don’t ask!

After the good-ole days of school, the thought of owning a home seldom crossed my mind.  I knew nothing about the process and was living under the assumption that I would have to have a large down-payment whenever the time came.  I didn’t feel comfortable asking questions.  I did not want to appear stupid.

A few years later, a friend who was a mortgage geek asked me why I had not purchased a home.  Being self-employed, I really did not know where to start, and did not want to admit it.   Swallowing my stupid pride, I finally laid all the pieces to the puzzle out there and purchased a home weeks later.  Then, I backed up to the “ass-kicking machine” for not asking someone sooner!  It really was that easy…and still is today!

Every year you do not own a home is another year you will not build financial security.  If the home you purchase does not go up in value at all, it will still be yours when it is paid for and you still have something to sell.  Home Equity loans have also put many children through college.  No apartment complex has ever managed to do that… except for its owners!

Lets address a few of the many questions that our first-time buyer of today might want to ask:

1)   How much down-payment will I have to have?     Don’t you just hate hearing the answer, “it depends.”  I do, and refuse to use that as an answer.  In most cases, you will have to have a minimum down-payment of 3.5% of your home’s purchase price.  In Tennessee, first-time buyers using THDA’s Great Start can purchase a new Nashville area home with ZERO down payment and ZERO cash out of pocket.  Of course, certain credit and income restrictions apply, but the program is relatively easy to qualify for.   Visit www.thda.org for more details.

2)  Just what are closing costs?   Much like purchasing a car, closing costs include sales taxes and various fees.  The costs of obtaining your loan are also closing costs, and there are many options there as well.  Also included is an escrow account where you property taxes and insurance is pre-paid into the future.  Typical closing costs to range between 3 to 4% of the purchase price of your home.  This amount is due at the time of closing.

3)  Who pays closing costs?  Everybody pays in one way or another!  Who gives the money at closing is negotiable.  It is very common for buyers to negotiate with the seller to pay closing costs.  If you purchase a new home with Ole South, ALL of your closing costs are paid when using our network of preferred lenders.  In any case, we will pay 2% toward your closing costs with any lender.  We make it easy to own a new home.

4)  How much money do I need when I decide to contract on a home?  The deposit amount you place when you contract is a negotiable figure between buyer and seller.  That deposit is called “Earnest Money” and is held in escrow to apply toward your cash requirements at closing.  We at Ole South ask for a minimum $500 deposit at the time of contract.  If you use the THDA Great Start program through Ole South Financial, you will receive this deposit back at closing!

5)  When do my payments start?  Payments on your new home do not start until the home is completed and the transaction is closed.  Typical first payments are due 30 days forward to the 1st of the next month.  If you close on April 15th, your first payment will be due on June 1.

Nashville New Homes: There’s a lot we can do!

When you hear disappointing news, sit back and ask yourself what can I do about it?”   In many instances, the first and easiest answer that pops into mind is “nothing.”   Isn’t it time that we all think just a little deeper for a better answer?  There is a LOT that we can do.  And we need to start doing it!

Statistics show that for every 100,000 homes that are built, 150,000 construction jobs are created, ALONG WITH 150,000 manufacturing jobs related to appliances, furniture, etc.  Hmmm… for every new home sold, THREE JOBS are created (or saved!)  That means our loyal Ole South home buyers created or saved over 800 jobs last year alone!

I have a silly question.  If statistics prove that housing creates (and saves) jobs, then why is our government taking steps to discourage home ownership?

There is discussion within BOTH political parties on Capitol Hill about eliminating the home mortgage interest deduction.   There are alternatives being discussed as well, but we need to be informed.  With everyone acknowledging that housing is the key to economic recovery, why are they even considering anything that would have questionable effects on home ownership?  Here is more information on this subject:

Nashville New Homes: It’s not personal.

In new home sales, or any sales field for that matter, there is rarely the perfect time to schedule a week-long trip.  What are you going to miss?  What will you return to?  These are questions that go through the mind.

 This year, we managed to select the perfect week for our mission in Honduras, which hopefully you read about in past postings.  We missed the largest snowfall of the year and we missed the most frigid temperatures recorded this winter.  On our return day, the weather turned near perfect!  What timing!

The warmer weather turned loose a hotbed of activity in the new home market with our sales and traffic at levels we had not seen since the home-buyer tax credit expired last year.   I am proud to say that ALL of our available new homes in Nashville’s Spencer Hill are now pending!   And we’re starting more, even a 4-bedroom home for $149,990!

 The one thing all prospects have in common right now is they all are expecting  “a deal.”   

They’ve heard all the national statistics on home sales and they are also hearing us shout “now is the time”  from our rooftops.  They are reacting by exploring their options.  We have to react smartly and cannot afford to let emotions block the way to a potential sale.    

There have been recent examples of transactions that could not be fathomed at any other time.  Mansions listed for 1.5 million selling for 800k, short-sales of homes where 180k is owed selling for 150k or less, etc.  Transactions like these are what prospective buyers have heard about.  Even though these transactions are not the mainstream in Nashville, their expectations have been raised.  It is our charge as Realtors to keep expectations in check, but most of all make everyone involved realize that “it’s not personal.”

Realtors are solutions to needs and desires.  Most Realtors have a realistic idea of what can be accomplished in a successful deal and set expectations accordingly.   Listing Agents and Buyer Agents have a duty to set parameters within reality. 

Buyer agents have an exceptionally difficult task in balancing their clients expectations and the reality of a successful offer.  Their clients have to know that they hit “rock-bottom”  without leaving a single dime on the table.  The process may start with an offer of ridiculous expectations, and it may start with an offer closer to reality.   It depends on the Buyer Agent and the desires of their client, but in neither case is to be taken “personal.”

Listing agents also have their hands full.  When was the last time you presented an offer to your “seller” only to hear  “They want WHAT?  Do they think I am a fool?  To hell with them, etc…”  The listing agent also has to set expectations, and focus much harder on taking emotions out of the picture when presenting offers.  “It’s not personal!”

Nashville is very fortunate to have a diverse population, and especially fortunate to be a destination for people relocating to the United States from other countries.  Negotiating tactics vary and must be kept in perspective.  In many countries, negotiations start AFTER everyone has agreed.  All of us have to know that this is simply a process and not an indication of the buyer’s honor or integrity.  “It’s not personal.”

In negotiating a recent contract, the laundry list of items and price concessions appeared endless.  You CAN do this and that.   Yes, technically we could.  But, we won’t.  It’s not personal.

The most important ingredient to any negotiation is the element of mutual RESPECT.  Without that, your deal will go no where.

Let the negotiations begin!

Nashville New Homes: 2011 – The Year of the New Home.

For the past several years, those bearing bad news have held a firm grip on the microphone.   After all, they had a lot of negative things to report, so lets not blame them.   Bad news does sell.  And people do buy it…that is, until they have heard enough!

Since the first of January, I have been asking prospective home buyers a question…. “If you had purchased 60 days ago, you could have saved a little bit more money.  Interest rates have edged up slightly, even though they are still at record lows.  Just what has made you come out to explore now?”  (Please keep in mind that these prospective buyers are among the NINETY PERCENT of people that still have jobs in this country.)

 The responses are very much the same across the board.  “I’m hearing more positive news, I feel good about my job, and I know my rent will probably go up next year.”   OR …  “We’re getting closer to retirement and probably won’t have another chance to buy with interest rates this low.”

Folks, the “bearers of good news” are now getting their time at the microphone!   And the message is getting across.  It is certain, and sad, that many Americans are still without work.  The NINETY PERCENT that still work will be the ones that turn this economy around, and help put those unfortunate ones back to work.  If we truly want that to happen, we’ve got to communicate positive news whenever possible.

We all know that the price of things are a simple result of “supply and demand.”  We all know that there is a finite supply of land… there’s just not any more of it being made.  Here’s another opinion of why now is the time to buy:

No two pieces of property are the same, and no two areas are alike.   You have got to weigh the “risk vs. reward” and at the same time keep in mind that you are buying a home first, and investment second.  And the most important part…. you will one day own it, something you cannot say for your apartment.

From a person that specializes in selling new homes, there is a good chance you will always hear … “now is the time to buy.”   We are not trying to be intentionally misleading.  In most cases, compared to renting, “anytime is a good time to buy, but some times are better than others.”  Feel free to quote me on that!

How things are really does depend how you choose to look at things.  I prefer optimism over pessimism anyday.

One thing I can say factually, there is a small village in southern Honduras, near Choluteca, that will soon be looking at their homes in a totally different light….actual light…. at night!  They will also have access to filtered drinking water for their homes, and a more healthy cooking stoves thanks to District 6760 of Rotary International.

There will more than likely not be any blog posts until I return, but you can count on quite a few recaps then!  Many people warn about posting travel information online, and for very valid reasons.  I have a few valid reasons not to worry about that:  A great home security system, a wife that is proficient with guns, and good insurance.  Bring it on!

Nashville New Homes: 2011’s going to be fun!

If last night is any indication, 2011 is going to be a great year.  Not just for new home sales, but for having fun as well!   Middle Tennessee Realtors packed the Embassy Suites Hotel Ballroom in Cool Springs to “Kick-Off” 2011 with all of us at Ole South.  Great food, drinks, music, and fun was on the agenda.  So was giving away money, lots of it!

The turnout was spectacular and the room was filled with enthusiasm for 2011.  We are fortunate to have a lot of great Realtors in Middle Tennessee and blessed that they are good friends too.  They could have spent their evening somewhere else, and we are honored that they chose to spend their time with us! 

Whenever you have that many Realtors in one place, you have to tell them all about your company and the exciting plans we have for the new year.   New things like these:

 *  ALL BRICK HOMES in Williamson County, featuring outdoor living areas, 4 BR, 3.5 bath, Formal Dining, Bonus Room, and a 3-car garage for under 300,000.

*   The most affordable new homes in Metropolitan Nashville.  Town homes from 89,990 in Old Hickory Commons and Traditional homes from 109,990 in Spencer Hill.

*   The introduction of ‘FUTURE PROOF” homes in many Ole South neighborhoods.

*   A totally new introduction of floorplans in the low 100’s in our flagship community, Evergreen Farms in Murfreesboro.

*   The introduction of new town home models featuring walk-out verandahs and covered rear porches.

*   Our recent expansion into the Clarksville, Tennessee market.

*   And too many other things to list!

On display were many fine products used in the construction of our homes.  Special thanks to Alsides, Ferguson Enterprises, Home Center Network, Marsh Cabinets, Metro Carpets, Mold Stoppers, Ole South Financial/SunTrust Mortgage, Tri Star Title and Escrow, and Union Station Brick & Stone for their participation in the program!

We also gave away $11,000 during the evening.  24 Realtors won gift cards in amounts from $100 to $1100!  Many of our vendors gave away prizes also. 

I really enjoy watching events like this one come together.  It gets even better when everyone has fun!
